1. About TareLink

TareLink operates an online platform that connects customers needing materials delivered or vehicles hired with independent transport operators and drivers ("Carriers"). TareLink is a marketplace and intermediary only — it is not the carrier, does not own or operate the vehicles, and does not perform the cartage itself. Contracts for the delivery or hire are formed directly between the customer and the Carrier.

2. Eligibility & accounts

You must be at least 18 and authorised to enter agreements on behalf of yourself or your business. You are responsible for the accuracy of your account details and for keeping your login secure.

3. Customer responsibilities

Customers are responsible for providing accurate order details (material, quantity, site access, contacts), ensuring the delivery site is safe and suitable for heavy-vehicle access, and paying for confirmed deliveries.

4. Carrier, driver & transport-company responsibilities

Carriers warrant that they and their drivers hold all current licences, registrations and insurances, that their vehicles are roadworthy, and that they comply with all applicable laws — including the Heavy Vehicle National Law (HVNL) and their Chain of Responsibility (CoR) duties (fatigue management, mass/dimension/load-restraint, vehicle standards and speed). Compliance tools provided in TareLink (e.g. fatigue prompts) are aids only and do not replace the operator's own legal obligations.

Work & Rest. For work within 100 km of the driver's base, TareLink's Work & Rest taps are the driver's local area work record: each tap, the truck's rego, and the daily and weekly totals. TareLink keeps every Work & Rest entry for at least 3 years. Entries can't be changed once saved. TareLink staff remove an entry only if it was made in error or for testing. It is not an approved electronic work diary: for work more than 100 km from base the driver still needs the National Driver Work Diary. Drivers and their employers remain responsible for making sure the taps are right and for keeping any other records the law asks of them.

5. Bookings, payments, fees & cancellations

Payment is processed through TareLink's nominated payment provider. TareLink may charge a platform/service fee. Cancellation, refund and expiry terms apply as described in the booking flow.

6. Disclaimers

The platform is provided "as is". TareLink does not warrant the quality, suitability, timeliness or legality of any Carrier's services or any customer's materials or site, and does not guarantee delivery times. Estimates (weights, distances, prices) are indicative only.

7. Limitation of liability

To the maximum extent permitted by law (and subject to the Australian Consumer Law), TareLink is not liable for loss or damage arising from the acts or omissions of customers or Carriers, the transport itself, or your use of the platform. [Lawyer to insert cap and exclusions.]

8. Indemnity

You agree to indemnify TareLink against claims arising from your breach of these terms or your own acts or omissions. [Lawyer to confirm scope.]

9. Suspension & termination

TareLink may suspend or terminate accounts that breach these terms, present a safety or compliance risk, or misuse the platform.

10. Governing law

These terms are governed by the laws of Queensland, Australia. [Confirm jurisdiction.]

11. Changes to these terms

We may update these terms. When we make material changes we will update the version above and ask you to accept the new version before continuing to use TareLink.
